Carelessness or deviating from the reasonable standard of care

Has to do with forming relationships

Lead according to the situation while you’re adapting to it

It’s similar to Maslow’s but more simple, it’s binary between high and low
Element of Malpractice: Duty owed to the patient example
for example not monitoring the patient’s response to treatment

You didn’t report to the provider that the patient’s status changed
Element of Malpractice: Foreseeability example
You didn’t make sure the minimum standards are met

because of your actions, the patient has to stay in the hospital longer, pay more medical bills, etc

Means that employers can be responsible for the employee’s actions

if the institution gets sued, they can turn around and sue the nurse because they’re saying Hey we just got sued because of you
Corporate responsibility includes having a lack of ___ staff
lack of qualified staff
Failure to warn
A nurse manager is accountable if they didn’t warn other employers/the state about the actions of the employee
Qualified privilege
IF the employee lists you on their application, you can disclose negative info about them
Apparent Agency
this means that the organization is responsible for contracted employers (whereas in the past the staffing agency was responsible)
Privacy vs Confidentiality
Privacy means you don’t get in people’s business for no reason, confidentiality means you don’t SHARE their business
Autonomy
You have the right to make your own choices
Beneficence
Your actions should promote goodness
Nonmaleficence
Do no harm
Justice
Treat everyone equally
Paternalism
someone making decisions for someone else (it’s a bad thing usually)
Fidelity
Keeping promises
Respect for others
Basically same thing as autonomy
Moral distress
When 2 ethical principals compete
Malpractice: the nurse’s duty (in part) is determined by the
institutional standards
Malpractice: the 2nd step is
showing that the duty owed was not given
Malpractice: foreseeability means
you could’ve seen it coming
