General overview
[408.01] Section 408 deals with default penalties, i.e. the penalty to be meted out to a person who after the date of conviction of an offence continues to commit that offence. If the amount of default penalty is not mentioned, this section provides that it shall not exceed $200: s 408(1).

[408.02] Whenever the phrase “officer who is in default” or any like phrase is used in the Act, it means an officer who is knowingly and wilfully guilty of the offence, or authorises or permits the commission of the offence.
