205AE. Privilege against defamation

General overview
[205AE.01] This section absolves the company or any person from an action for defamation in two situations: (a) in the absence of malice, in respect of the publication of the written statement sent to the members under s 205AC(1); or (b) in respect of the publication of the written statement sent to the members under s 205AD(4)(b). Unlike the written statement that was sent under s 205AC(1), the written statement sent under s 205AD(4)(b) has been adjudicated and found not to be defamatory under s 205AD(4)(b).
