General overview
[12A.01] The previous system of manual lodgment and registration of documents has been repealed in favour of an electronic transaction system which allows for the electronic transmission of documents for more efficient registration of documents.

[12A.02] Act No 36 of 2014 has repealed the previous s 12A and establishes an electronic transaction system which allows the transmission of documents electronically to ACRA under the Act, and the issuance of any approval, certificate and notice, determination or other document under the said system. This supersedes the electronic filing system established under the Act.

[12A.03] The registrar, if satisfied that a transaction should be treated as having been carried out at some earlier date and time, may cause the electronic transaction system to reflect such earlier date and time: see s 12A(2). The powers of the registrar under subsection (2) should be exercised sparingly, especially where the question of priorities of charges and rights of third parties are affected.
