All employees are entitled to work in an environment free of offensive or disparaging conduct. Therefore, it is the policy of this department to strictly prohibit any conduct by its employees which defames or demeans the nationality, culture, color, creed, belief, or sex of any person. Specifically, employees shall not: [FCAC 4.09]

a. Use coarse, profane or insulting language, nor shall they speak disparagingly nor make or tell jokes about the race, sex, religion, national origin, age, handicap, or marital status of any person;
b. Participate in any practical joke which could adversely affect the physical or mental well-being of a departmental employee; or
c. Behave in any other manner that substantially interferes with any individual departmental employee’s work performance or creates an intimidating, hostile, abusive, or offensive working environment.

In accordance with Equal Employment Opportunity Commission (EEOC) Guidelines, harassment on the basis of sex is a violation of Section 703 of Title VII of the Civil Rights Act of 1964. Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature constitute sexual harassment when:

A

a. The employee must submit to the offensive conduct as an explicit or implicit condition of employment;
b. Submission to, or rejection of, such conduct is used as a basis for employment decisions affecting the individual;
c. The employee’s job performance is interfered with as a result of the offensive behavior; or
d. The work atmosphere becomes hostile, offensive, or intimidating
