An injunction for protection issued by another state, the District of Columbia, an Indian tribe, or a commonwealth, territory, or possession of the United States (U.S.).
Foreign Protection Order
A court order that prohibits or restricts a person’s ability to have contact with another person or from doing a specified act
Injunction for Protection
– The person who petitioned the Court to issue an injunction for protection, either for his/her protection or for the protection of an immediate family member
Petitioner
Two or more incidents of violence or stalking committed by a suspect (one of which must have been within the last six months) against a victim or one of the victim’s immediate family members.
Repeat Violence
The person who, pursuant to an injunction for protection, is prohibited from making contact with another person or doing a specified act.
Respondent
A court order issued by a judge, following the filing of a “Petition for Injunction for Protection against Domestic, Repeat, Sexual, or Dating Violence,” that remains in effect until a full hearing can be held or for a period of fifteen days, whichever comes first. If just cause is shown, the Court can extend the expiration date of a temporary injunction beyond the initial fifteen days.
Temporary Injunction for Protection
The Arrest & Booking Report narrative must include:
a. A statement that the injunction for protection was verified through the Florida Crime Information Center (FCIC);
b. The court division that issued the injunction for protection; and
c. The specific way(s) the respondent violated the injunction for protection.
Prior to taking enforcement action for violation of a foreign protection order, the investigating officer shall review the order to determine it is still____________
valid.
When the Clerk of Court receives an allegation that an injunction for protection was violated, the Clerk shall send the following documents to the SAO Liaison via email:
a. “Petition by Affidavit for Order to Show Cause for Violation of Final Judgment for Protection Against Violence”; and
b. “Domestic Relations Identification Sheet,” which contains the respondent’s personal information.
A foreign protection order that has been served on a respondent is enforceable in Florida, even when
Florida residency has not been established or when the injunction has not been registered or recorded in Florida.
