A
  1. An officer has been made aware of a subject who has made credible threats to cause significant bodily injury in a public or private place where multiple people would ordinarily congregate. Examples include places like schools, churches, hospitals, or office buildings;
  2. An arrest is made for a criminal offense pursuant to an RPO; or
  3. An officer, after consultation with an on-duty supervisor, requires guidance regarding the RPO process for a subject who appears to meet the RPO criteria.

ammunition. It also prohibits the individual from having a concealed weapon license for the

Criminal Offenses Pursuant to RPOs

  1. Violation of an RPO
A

a. A subject commits a third-degree felony of violation of an RPO if he/she:
(1) Has been served with an RPO; and
(2) Purchases, possesses, or receives any firearm(s) and/or ammunition..

For an officer to have probable cause to arrest a subject for a violation of an RPO, the officer must have confirmed, via the Identification Unit, the RPO is valid and has been served to the subject.
