What is wholesaling? (5)

A

Medicinal products sold to a person who sells or supplies it to someone else or administers it to someone else.

In other words, medicines not used on themselves.

It’s a sale, money must change hands.

Anyone trading medicines other than to a patient must have a wholesale dealers license from MHRA.

Pharmacies supplying stock to another pharmacy within the same legal entity don’t require a wholesaler licence.

What guidance does the MHRA give about wholesaling from a pharmacy? (5)

A

There’s no need for supplying pharmacy to hold a wholesale licence providing that the supply of medicine is to another pharmacy or a HCP for treatment or onward supply to a patient and it:
- Takes place on an occasional basis +
- Quantity supplied is small +
- Supply is made on a not-for-profit basis +
- Supply isn’t for onward wholesale distribution.

Which professionals may a retail pharmacy wholesale medicines to? (4)

A

Sales of POM medicines may only be made if the purchaser is authorised to seek or supply the foods or to administer them to humans in the course of their business or professional practice:

E.g. practitioner (doctor, dentist), another retail pharmacy, hospital or clinic, ophthalmic opticians (only certain POMs) or any other person exempted from the POM order but only for the products exempted e.g. orthoptists)

Also NHS trusts, owner/master of ship, armed forces etc.

Exercise caution when selling any POM without Rx.

What other points do you need to consider for wholesaling? (5)

A

Medicines can be written on a requisition i.e. signed order.

There’s no legal requirement for details that must appear on a requisition.

It’s preferable to supply whole packs.

No legal requirement for pharmacy to label the stock but it’s good practice to do so.

Hospital pharmacies that aren’t registered pharmacies may not wholesale without a wholesaler licence.

What records need to be made for wholesaling? (3)

A

No legal obligation to make a record in the POM register so long as the signed order is kept for 2 years from the date of supply.

It’s good practice to make a record in the POM register and keep the invoice for 2 years.

If there’s no signed order then legally a POM register entry must be made.

What particulars needs to be included in the POM register for wholesaling? (4)

A

Supply date
Medicine name, quantity, form and strength. (Dose.= good practice)
Purchaser’s name, address, trade, business/profession.
POM’s purpose.

What are the main features for optometrist signed order for patients? (8)

A

Optometrist can’t write POM Rx unless they’re an IP or SP.

Signed order isn’t legally considered a Rx so there’s no legal requirement.

2 sections: drugs for administration and supply.

Only a drug listed in the drugs for supply can be supplied to a patient of the optometrist.

Check register of opticians if they’re qualified to do this.

The medicine should be labelled as a dispensed medicinal product and a PIL should be supplied.

A record is made in the POM register.

If in doubt, ask for help.

What are the main features for podiatrist signed order for patients? (6)

A

Podiatrist A.K.A. Chiropodists can’t write Rx for POMs unless they are IP/SP.

POM-S = qualified to sell, supply or administer selected POMs, all P and GSL medicines.

POM-A = qualified to administer selected POMs.

A record needs to be in the POM register.

Only drugs listed in the drugs for supply can be supplied to a patient of the podiatrist.

A

Keep the signed order for 2 years and it’s good practice to make record in the POM register.

The pharmacist should ensure the school knows how to store and use the medicine correctly and draw their attention to expiry date.

Record keeping and regular date checking.
