(1) Law Enforcement Agencies – An IA (Interagency Agreement) will be created by the JSO FAC office and sent to
the requesting agency for signature by their agency head.
(2) Government Agencies (Non-law Enforcement) – An MCA (Manage Control Agreement) will be created by the JSO FAC office and sent to the requesting agency for signature by their agency head.
c. When the signed agreement is returned to the JSO FAC office, it will be sent via chain of
command to the Sheriff for signature.

4. Arrests at the Base
a. Arrests at the Base by the JSO shall not occur without prior coordination with the SJA (Base Judge Advocate), and in the case of a military member, with the consent of the Base Commanding Officer or his/her designated representative. The SJA is the Base Commanding Officer’s
designated representative.

c. When the delivery of any military member or civilian for the purpose of executing an
arrest warrant is requested by the JSO, the arresting officer shall provide the arrest
warrant to Base Security. The Security Office is required to consult with the SJA in order
to obtain permission to deliver the military member to the JSO for arrest. The
Department of the Navy shall deliver military members pursuant to a valid arrest
warrant and refuse delivery only when extraordinary circumstances exist. Once
permission has been obtained from the Base Commanding Officer or his/her designated
representative, the warrant shall be executed at a place to be determined by the SJA.

e. Civilians cannot be compelled to report to a designated place for the execution of a
warrant. NCIS, Base Security, and the SJA shall assist the JSO with the execution of arrest
warrants issued for civilians located at the Base.

  1. Fresh Pursuit [CALEA 41.2.2]
    a. Any JSO officer, who observes the commission of a misdemeanor (including traffic
    infractions and crimes) and pursues the offender without unreasonable delay; or
    observes the commission of a felony or has reasonable grounds to suspect a felony has been committed, and pursues the offender without unreasonable delay, shall be
    authorized to continue that pursuit across the boundary of the Base. The Commanding
    Officer of the Base retains the ultimate authority to protect the Base from any threat
    regardless of the type of jurisdiction present.
    b. As soon as it reasonably appears that the fresh pursuit of the suspect shall require entry
    at the Base, the officer involved shall promptly notify Base Security of the entry and
    request assistance.
