What might the Board require of a licensee (having to do with the psychologist rehabilitation committees)?
The Board may require education, supervision, substance abuse treatment, medical care, and/or personal psychotherapy of a licensee. Psychologists may also self-refer to this committee.
What is a psychologist rehabilitation committee? What is their function(s)?
A committee of the Board or the MPA that is recognized by the Board and includes, but is not limited, to psychologists.
This committee evaluates and provides assistance to any psychologist, and any other individual regulated by the Board, in need of treatment and rehabilitation for alcoholism, drug abuse, chemical dependency, or other physical, emotional, or mental condition.
The Board may refer a psychologist to this committee instead of taking punitive action.
What is the rule regarding discoverability and admissibility of proceedings, records, and files of the psychologist rehabilitation committee?
These things are not discoverable/admissible in evidence on any civil action, except:
The committee must report all violations of law that they learn about in the process of providing services to psychologists.
What does the psychologist rehabilitation committee do for the Board?
The committee monitors and oversees the treatments received by psychologists (through the committee) and periodically provides written reports to the Board re: the psychologist’s participation and progress.
What is the good faith exemption from civil liability as related to the psychologists rehabilitation committee (PRC)?
A person who acts in good faith and within the scope of the PRC is not civilly liable for any action as a member of the PRC or for giving information to, participating in, or contributing to the function of the PRC.
Is the MPA Colleague Assistance Program the same as the psychologists rehabilitation committee (PRC)?
No, but it used to be. Now the MPA CAR is a medical review committee, not a PRC.
