How are Board members appointed? What happens when there are vacancies?
A list of psychologists is submitted by the Maryland Psychological Association (MPA), and the Governor appoints the Board members from this list, with the advice of the Secretary and with the advice and consent of the Senate.
The MPA notifies all licensed psychologists in the State of Board vacancies to solicit nominations to fill any vacancy. The MPA conducts a balloting process where every licensed psychologist is eligible to vote to select the names that will be submitted to the Governor.
How many Board members are there? What is the composition of the Board?
= 9 members; 2 consumer members, 7 licensed psychologists (at least 2 engaged primarily in providing clinical services; at least 2 engaged primarily in teaching, training, or research in psychology).
What are the 3 qualifications of psychologist members of the Board?
1) a licensed psychologist who has practiced, taught, or engaged in research in psychology for at least 5 years.
2) a citizen of the U.S.
3) a resident of MD
What are the 6 qualifications of consumer members?
1) shall be a member of the general public.
2) may not be or ever have been a psychologist or in training to become a psychologist.
3) may not have a household member who is a psychologist or who is in training to become a psychologist.
4) may not participate or ever have participated in a commercial or professional field related to psychology.
5) may not have a household member who participates in a commercial or professional field related to psychology.
6) may not have had (within 2 years before appointment) a substantial financial interest in a person regulated by the Board.
NOTE: when a member of the Board, a consumer member may not have a substantial financial interest in a person regulated by the Board.
What is the term of a Board member? How many consecutive terms may a member serve?
How do terms and vacancies work?
= 4 years.
= not more than 2 consecutive full terms.
Terms of members are staggered. At the end of a term, the member continues to serve until a successor has been appointed. The Governor shall fill any vacancy within 60 days, of the date of the vacancy, to the extent possible.
For what actions can a Board member be removed from the Board? By whom?
The Governor may remove a Board member for:
1) incompetence
2) misconduct
3) upon the recommendation of the Secretary, for absence of 2 successive (in a row) Board meetings without adequate reason.
