The contractor has the obligation to provide warranties for the following:
Any construction defects related to installation or materials within the first year after substantial completion or occupancy. This is sometimes called an implied warranty
When is substantial completion of work obtained?
When the owner can take possession of the structure for its intended purpose.
What warranty do the fixtures and equipment installed by the contractor or sub have?
Manufacturer warranty.
Does the contractor have to keep warranties for installations?
Yes, for future warranty service.
What should be retained on a contractors file?
Sump pump or well pump Furnace Electronic air filters and humidifiers Faucets Garbage disposal Light fixtures Built in dishwasher Built in microwave Windows Garage doors and electric openers Roofing materials Finished floor products
When is a contractor responsible for a construction defect?
The contractor is NOT responsible for architect design error or that of an engineer. If the contractor notices one, he is required to bring it to the attention of the design professional.
