What is The Mental Health Act (1983)?
main piece of legislation that covers the assessment, treatment and rights of people with a mental health disorder
what does it mean if someone has got sectioned?
are cases when a person can be detained under the mental health act and can be treated without their agreement
who decides if someone has to be detained?
-Police:have powers to enter your home, if need be by force, under a Section 135 warrant
-Nurses:can stop you leaving under Section 5(4) until the doctor in charge of your care or treatment
-Doctors:ability to detain someone in hospital for up to 72 hours, during which time you should receive an assessment that decides if further detention under the Mental Health Act is necessary.
what does the length of an individual being detained depend on?
epends on the type of mental health condition you have and your personal circumstances at the time.
how can someone appeal being detained?
right to appeal against the decision to the Mental Health Tribunal (MHT) or to the hospital’s managers.
what is the MHT
MHT is an independent body that decides whether you should be discharged from hospital.
what is a section 17 leave?
while detained under the Mental Health Act, you may be able to leave the hospital if authorised by the doctor or clinician in charge of your care

being discharged or allowed out of the hospital on short-term leave, you may be put under a Community Treatment Order (CT

A guardian is someone who can help you live outside of hospital.
