A
• Issue, determine if there is a substance abuse problem
• Rule, HPM 9.2 Substance Abuse manual states no employee, in a sensitive position, who is on duty or on a standby for duty shall:
Use, possess, or be under the influence of illegal or unauthorized drugs, or other illegal mind altering substance or use or be under the influence of alcohol to any extent that would impede the employee’s ability to perform duties
- Is there a crime? If so handle as you would normally a crime
- Inform employee of the observation and why they are a concern
- Allow for an explanation but mindful of POBR
- Keep under observation until sample is collected
- Determine if R/S exist to test.. Confirming Official
- Maintain confidentiality
- If not designated as sensitive position.. Emp must volunteer sample
- Once R/S has been confirmed by C/O, advise empl decision to test has been reached
- Advise employee of possible consequences of positive test
- No threats to submit to test, just failure to test could constitute insubordination and can result in AA
- Alcohol only: breath machine
- Drugs: Urine. 2 samples
- Secure setting
- No Union Representative
- Allow to dress down, if drugs… Peace officer powers request suspended by Commissioner
- Drive home, don’t allow employee to drive themselves.
- Dock status remainder of shift, return following day if nothing in system. Drugs not until results are known and negative (ATO)
- 202X report in 48 hours, copy to employee
- Memo to Medical Review Officer
- Offer Employee Assistance Program
