What is MLC

A

The international maritime labor convention

It is an international convention that sets standards for seafarers rights, working and living conditions.
It is considered the 4th pillar of the IMO and makes it easier for governments and ship owners to apply the system and provide decent working conditions.

Which ships does MLC apply to.

A

To all UK registered sea going vessels where ever they may be and to non-uk ships in UK waters.

500gt and over. Vessels under 500gt don’t have to be certified but is required to demonstrate compliance with national employment laws.

What is a seafarers employment agreement

A

A seafarers employment has replaced the crew agreement.

It is similar to a traditional employment contract where every crew member has their own individual contract.

What are the hours of rest for an adult

A

No more than 14 work hours in a single day
No less than 10 hours rest

10 hours may be broken into two but one may not be less than 6 hours

No more than 72 work hours in a 7 day period
No less than 77 rest hours on a 7 day period

What two documents are required for MLC certification, what are there requirements and survey frequency?

A

Maritime labour certificate:

Document is evidence that then vessel mets convention requirements. Flag state certificate, inspection can be done by recognised organisation usually Class. Valid for 5 years subject to intermediate, renewal inspections.

Declaration of Maritime labour compliance:

2 parts.
Part 1, completed by the attending surveyor, identifies topics for inspection and lists relevant pieces of legislation.

Part2, Completed by yacht owner and verified by attending surveyor. Declares details of the measures adopted by the yacht owner to ensure ongoing compliance.
