LOCAL LAW 62 for the year 1981 requires that all existing dwelling units within Occupancy Group J-1 (which includes Hotels, Motels, Lodging Houses, and Rooming Houses) and Occupancy Group J-2 (which includes Apartment Houses, Apartment Hotels and School Dormitory Buildings) and;
New buildings or substantially improved or altered buildings in Occupancy Group J- 1, J-2 and J-3 (J-3 includes One and Two Family Dwellings, Rectories, Convents and Group Homes) to be equipped with approved smoke detecting devices, EXCEPT SUCH units which contain operational automatic wet sprinkler systems.

Smoke detectors shall be located on or near the ceiling and within fifteen feet of all rooms used for sleeping purposes in J-2 or J-3 occupancies. In all dwelling units with multiple levels, when any level has only one means of egress, the dwelling unit shall be provided with smoke detectors on all levels.

LOCATION OF REQUIRED SMOKE DETECTORS UNDER THE 2008 BUILDING CODE

Smoke alarms in Groups R-2, R-3 shall be installed and maintained in Groups R-2, and R-3 regardless of occupant load at all of the following locations within a dwelling unit:(BC 907.2.10.1.1)
• On the ceiling or wall outside of each room used for sleeping purposes within 15 feet from the door to such room.
• In each room used for sleeping purposes.
• In each story within a dwelling unit, including below-grade stories and penthouses
of any area, but NOT INCLUDING crawl spaces and uninhabitable attics.
Note: In dwellings or dwelling units with split levels and without an intervening door between the adjacent levels, a smoke alarm installed on the upper level shall suffice for the adjacent lower level provided that the lower level is less than one full story below the upper level.

Interconnection
3.3. Where more than one smoke alarm or detector is required to be installed within an individual dwelling unit in Group R-2, R-3, or within an individual dwelling unit or sleeping unit in Group R-1, the smoke alarms or detectors shall be interconnected in such a manner that the activation of one alarm or detector will activate all of the alarms or detectors in the individual unit. The alarm or detector shall be clearly audible in all bedrooms over background noise levels with all intervening doors closed.(BC 907.2.10.3)
Smoke detectors within R-1 dwelling units
3.4. Smoke detectors and audible notification appliances shall be installed in dwelling units and shall be annunciated by dwelling unit at a constantly attended location from which the fire alarm system is capable of being manually activated. Smoke detectors are required in the following areas: R1 hotels
-In sleeping areas.
In every room in the path of the means of egress from the sleeping
area to the door leading from the dwelling unit.
In each story within the unit, including below grade stories. For dwelling units with split levels and without an intervening door between the adjacent levels, a smoke alarm installed on the upper level shall suffice for the adjacent lower level.
-Note: R-1 occupancies are also required to install smoke detectors in all public corridors serving dwelling units as per BC 907.2.8.2.
DURING INSPECTION, FIRE OR EMERGENCY OPERATIONS
- 1.1. For absent or defective required smoke detecting devices, the officer in command or his designee shall forward an A-8B Fire Dept. Referral Report (smoke detector) in duplicate to the Field/Public Communications Unit, Bureau of Fire Prevention. (Form A-8B is available on the Intranet) (See Attached)
- 1.2. Telephone notification is not required.
- 1.3. “Inspection” does not require that the inspector enter an apartment. Inspector may inquire about the S/D or observe same from the doorway if the tenant refuses
REQUIRED SMOKE DETECTING DEVICE AT A FATAL FIRE
- If required device is not found, Deputy Chief will make an entry on Fatal Fire Investigation Report (Item 22) and direct the administrative company to forward Form A-8B to the Field/Public Communications Unit.
- If a required smoke detector is found, the Deputy Chief will enter the brand name and model number, if available (Item 22) on Fatal Fire Investigation Report.
- Telephone notification is not required.
