It shall be unlawful to store, handle or use indoors portable fueled equipment, including lawn-care equipment and kerosene and other portable space heaters. The owner of a building, structure or premises shall not provide, or cause to be provided, any such equipment, including equipment designed for space heating.
-It shall be unlawful to store, handle or use for space heating, other than storage for sale, any portable fueled equipment that utilizes a flammable liquid as a fuel, or, except as authorized by Section 313.5 (see below), that utilizes a combustible liquid as a fuel. Any such portable fueled equipment that shows evidence of having been used shall be deemed to be in use (FC 313.3)

REMOVAL/CONFISCATION
- 1 The commissioner may confiscate or order the removal of portable fueled equipment from locations where the storage, handling and/or use of such equipment is determined by the commissioner to be hazardous. (FC 313.4)
- 1.1 If it is apparent that the space heater(s) has never been used, fueled, or ignited, it is deemed being stored illegally. In such instances a violation order shall be issued to remove the heater(s) “Forthwith” followed by an inspection 24 hours later by the administrative unit. A summons shall be served if the violation order is not complied with. If necessary, the administrative unit shall conduct surveillance to ensure future compliance.
If a space heater(s) is found fueled or ignited or shows signs of use, it is deemed in use. In such instances, a summons shall be issued (Fire Code section 313.3) and heater(s) confiscated. If the person in charge of the premises refuses to surrender the heater, it shall not be forcibly removed. Person(s) shall be informed that they are subject to arrest by Fire Marshals for obstructing governmental administration for refusing to surrender the heater. Fire Marshals shall be called through the dispatcher to respond forthwith if the person fails to comply. A receipt (Form BF-27) recording identification markings on the heater shall be issued to the individual who owns or is responsible for the heater and a copy is to be kept by the unit. The administrative unit shall be notified of the actions taken. Confiscated heater(s) and other contraband materials shall be confiscated and when appropriate transported by Fleet Maintenance as per Chapter 4 Addendum 6.*fleet is a change new)
