(2) It shall be unlawful to transmit two (2) or more unnecessary or unwarranted alarms in any three-month period, and it shall be unlawful to transmit any additional unnecessary or unwarranted alarms as set forth in R907-01(c)(4).

A

The owner (including any lessee or tenant) of any premises from which a second unnecessary or unwarranted alarm is transmitted in any three-month period will be subject to issuance of a notice of violation.

-An owner issued a notice of violation pursuant to R907-01(c)(3) shall be liable for a violation of that section for any subsequent unnecessary or unwarranted alarm within six (6) months of the date of issuance of the notice of violation. Each such subsequent notice of violation shall constitute a repeat offense pursuant to Administrative Code §15-229(a) and shall not be eligible for certification of correction without a hearing and penalty pursuant to R109-01(c). Each such subsequent notice of violation shall extend for an additional six (6) months the time the owner is liable for unnecessary or unwarranted alarms pursuant to this provision.

  • All smoke detectors connected to a defined fire alarm system shall be:
    (1) cleaned not less than once every six (6) months, except for analog (intelligent) smoke detectors, which shall be cleaned no later than one (1) week from receipt of an indication of the need for cleaning.
    (2) tested for smoke entry not less than once a year.
    (3) tested for sensitivity not less than once a year, except for analog (intelligent) smoke detectors, which shall be tested for sensitivity no later than one (1) week from receipt of an indication of the need for such testing.

ISSUING A NOTICE OF VIOLATION FOR UNNECESSARY/ UNWARRANTED
ALARMS
Fire Department field units will no longer be required to take enforcement action on the transmission of UNNECESSARY/ UNWARRANTED alarms as defined in 3RCNY 907- 01(c). Unit Officers will be required to transmit one of the following radio codes listed below at the time of the incident. The transmission of the 10-35 code will generate data that the 10-35 desk will evaluate in order to determine if an NOV should be issued against the owner, lessee or tenant for violation of 3RCNY 907-01(c). This new policy will centralize the enforcement efforts in order to promote greater safety standards. However, Company and Chief Officers should understand that at their discretion they can always issue an NOV for log book violations or an NOV/VO if the system is found not to be in proper working order as per FC 901.6.

2.4.1 10-35 Unwarranted or Unnecessary Alarm System Activation
Any alarm system activation that is unwarranted or unnecessary, excluding a sprinkler system alarm (use 10-34 Code 1, 2 or 3) or an alarm activation resulting from a utility power fluctuation (use 10-40 Code 2).
No Code:
Codes 1-4:
Unwarranted alarm. Alarm system activation caused by the defective condition of alarm device, equipment or system. Use this code for activations resulting from a low battery. Also use this code for activations without any known cause when no condition is found warranting an emergency response.
Unnecessary alarm. Alarm device, equipment or system operating properly but unnecessarily activated by lack of due care. Do NOT use this code for activations when there is a fire or other condition warranting an emergency response.
Code 1: Unnecessary alarm caused by alarm system testing or servicing.
Code 2: Unnecessary alarm caused by construction activities.
Code 3: Unnecessary alarm caused by ordinary household activities (toast, steam, aerosol spray).
Code 4: Unnecessary alarm caused by other causes…. For example, use this code for alarms resulting from cigarette smoking in unauthorized areas. When this code is used, a NYFIRS report must be completed setting forth the cause of the unnecessary alarm and the relevant particulars.
