Taney’s Dred Scott Decision

In 1846Dred Scott was taken by his master into Illinois and Wisconsin where slavery was illegal and his master died. In 1850 Scott sued the surgeon’s wife for his freedom
Taney(cheif justice) argued that slaves were property and the fifth amendment prohibiting Congress from taking people’s property.
Declared the Missouri Compromise unconstitutional
