What is found property?
Non-evidently property in the custody of the department, which has been determined to be LOST or ABANDONED and is not known or suspected to be connected with any criminal offense.
The Troop/Section cases in report supervisor shall
Sign and date, the station ledger as the final receiver of the property
Ensuring redline be drawn diagonally through the ledger entry to indicate final disposition and case closed
Destroy ECP, appropriate and acceptable manner in the presence of another commissioned officer
Submit a written report through channels to the appropriate Troop/Section, commanding officer, or design listing the final disposition of all ECP.
Can the department auction property?
Yes, pursue to MGL22C section 45 through 46. The department may:
Sell properties at public auctions or
Destroy held property and
Only sell or destroy health property after 6 months when there is no proven ownership of the property
Whenever there’s a change in an ECP, custodian an audit of the ECP under control of that station/section/unit shall be conducted in documented
This audit is to be conducted jointly by the newly designated ECP custodian in the station/section/unit commander or designee to ensure records are current properly annotated, and include the random sampling of ECP for verification.
On page 8 there is a high risk ECP Pieces of extra security measures.
Utilize this table to ascertain the random sample size of ECP requiring extra security measures.
Ex. Over 2,500 the required sample size would be 30%.
For all the other ECP not considered extra security or high risk then:
A random sampling of these items should also be included in the audit. The number of selected items for the sampling of all items should be a number that should be sufficient to ensure the integrity of the system and accountability of property.
If an audit rate of more than 5% is discovered, what should we do then?
Unfortunately, a complete inventory of the extra security ECP must be performed.
What does the Troop/Section commander do concerning audits of ECP?
Annually he assigns a supervisor, not routinely or directly connected with the control of ECP to conduct and document and audit of the ECP held by each station/Section/Unit.
Semi annual inspections of ECP;
Every six months the station/Section/commander with security storage areas for ECP, shall assign the supervisor responsible for the ECP control function to conduct and document an inspection of the secure storage areas.
What does the unannounced ECP inspection consist of?
At least annually by a designee not NOT routinely or directly connected with control of the ECP. Not intended to be a full inspection for cleanliness, or orderliness and trace a few pieces of ECP to verify the proper location.
Colonel may also direct unannounced random inspections of ECP storage areas
Record Maintenance of audits
With the exception of the unannounced inspections, the station/section/unit commander show me a record of all audits, semi annual inspections and unannounced inspections in a centralized location.
Auditor inspections that reveal missing ECP shall be:
Reported to the division commander of DST immediately.
