When will the department take action on a pregnancy?
When requested by the member or,
The members physician or doctor recommends work limitations
Who does a member notify she is pregnant? When does she have to?
Commanding officer
When reached her third trimester.
Requested modifications, exemption, relief, or assigned duties or
Been given physical restrictions, or limitation by healthcare provider that prohibits her from performing all aspects for current assignment
All notifications regarding pregnancy shall be made how?
In writing, and include the anticipated due dates, as well as anticipated date of return to work, if known.
Within 7 days of the initial notification letter from her healthcare provider what shall the member submit to her commanding officer going forward?
30 day written updates from her doctor.
A pregnant member not placed on alternative duty status shall:
Perform all duties required of her in her current position until such time as other duties are assigned consistent with this policy.
When may a pregnant member request in writing to be put in alternative duty status?
At any time during her pregnancy. (voluntary alternative duty).
Voluntary alternative duty, eligible members:
Shall not be transferred or have their shift changed involuntarily as the result of seeking alternative duty, however, a reasonable accommodation may require the member to accept temporary assignment in the geographic area of her current assignment or residence.
Involuntary alternative duty:
The department may involuntarily reassign a member to alternative duty based upon medical evidence that that member cannot safely perform her current duties.
Can a pregnant member challenge in involuntary alternative duty?
Of course she can. Why wouldn’t she? She must provide a statement from her healthcare provider that she can perform the duties.
Submit to an examination by neutral healthcare provider, selected by the member from a list, agreed upon by the department, and the representatives of the member’s CBA.
Be bound by the opinion of the neutral healthcare provider who then examines and renters in opinion.
What happens if an alternative duty assignment is unavailable with a members current assignment?
The colonel shall find an appropriate alternative assignment within the members immediate geographic area as defined by the Troop area of her current assignment or her residence and ensure no member is denied of this.
What happens if a pregnant member believes she has been unreasonably denied an alternative duty assignments in violation of this policy?
Submit a to/from Outlining objections to to the colonel.
What shall the colonel do when he receives notice that a pregnant member believes she’s been unreasonably denied in assignment?
Respond to the notice within 72 hours
Respond in writing, stating the position of the department with respect to the request
What type of vehicle should a pregnant member be issued when she’s on alternative duty?
An unmarked vehicle,
If unavailable provide her with a per diem rate, in accordance with the same terms and conditions as Mass port Authority employees of the same rank.
