What is the definition of assault?
The house of lords set the definition of assault as where the defendant intentionally or recklessly causes the victim to apprehend immediate unlawful force.
What is the AR of assault?
The actus reus of assault is any act that makes the victim apprehend the immediate infliction of unlawful force.
What is the MR of assault?
The mens rea of assault is intention to create the apprehension of unlawful force, or subjective recklessness.
What are the cases of the AR and MR of assault?
AR:
- Read v Coker - a threat of violence can amount to an assault.
- R v Ireland - silent phone calls can amount to assault or psychiatric injury.
MR:
- R v Mohan - attempting to cause injury is an intentional offence.
- R v Cunningham - the defendant should have forseen that harm would occur, therefore he was reckless.

The mens rea of battery is the intention to apply unlawful physical force, or being recjless as to whether such force is applied.
What are the cases for the AR and MR of battery?
AR:
- Haystead v DPP - direct force can be applied through someones action, it doesnt require direct physical contact.
- DPP v K - Battery can occur indirectly

- R v Mohan - attempting to cause injury is an intentional offence.
- R v Cunningham - the defendant should have forseen that harm would occur, therefore he was reckless.
