Issuance of a Civil Citation:
If the violator does not respond, the citation will be sent to the Miami-Dade County Finance Department’s collection division for processing. The citation fine may appear on the violator’s credit report, the violator will be unable to apply for any County licenses and, if the violator owns real property, the fine will appear on a title search and must be cured prior to selling the property.

Submit Civil Citation Scans to the GCO and Miami-Dade County Finance Department:
After the CAU staff enters the civil citation information into CAS, the CAU staff shall scan the civil citation, label the scan with the name of the citation (e.g., G12345), and send the scan to cereferrals@miamidade.gov (Clerk) and dscu@mdpd.com (PLB), within __ days of entering the citation into CAS. Each individual civil citation must be submitted in a separate PDF scan, one civil citation per PDF. Emails can include as many PDF attachments as possible.

Note Violator Signature Not Required: There is no legal requirement that the violator sign the civil citation, however, the deputy must ensure that the citation is given to the violator. If the violator
refuses to sign, the deputy should note on the signature line of the civil citation, “Violator refused to sign – citation served by hand.”

Citing by Civil Citation- Perform a Criminal History Check:
Similar to a traffic offense, deputies should run a criminal history check before issuing a civil citation and note the results. For violations that are arrestable, if the violator has no criminal past, and the violation can be cited as a civil citation, the deputy ___ use a civil citation to cite the violator. On the civil citation, in the Records Section of the citation, the deputy will check the “No Past” or “QRU” box, indicating that the violator does not have a criminal past. This information is kept to track the percentage of violators who were spared a criminal record.

POLICY:
Civil citations are for adult violators. Deputies should only issue civil citations to violators who are over the age of 18. Violators under the age of 18 may qualify for a _____ as provided in Florida Statutes §985.12, some restrictions apply.

Issuance of a Civil Citation:
Upon the issuance of a civil citation, the violator has three options: (1) pay the fine; (2) request an administrative hearing; or (3) register for the Miami-Dade County ______. Violators choosing the Diversion Program can complete community service hours in lieu of paying the civil fine. Information on the Diversion Program and how to register is located on the back of the violator’s copy of the civil citation.

Deputies are reminded that regardless of their decision to give a verbal warning, issue a civil citation, or make an arrest, the laws regarding stopping and detaining individuals remain the same. A deputy’s ability to stop and temporarily detain an individual is authorized when the deputy has ____ that a person has committed, is committing, or is about to commit a crime. Fla. Stat. §901.151. Also, like an arrest, the issuance of a civil citation should be based on the deputy’s probable cause determination that a violation of law has occurred.
