RPU Callout Criteria:
- An officer has been made aware of a subject who has made credible threats to cause
significant bodily injury in a public or private place where multiple people would ordinarily
congregate. Examples include places like schools, churches, hospitals, or office buildings; - An arrest is made for a criminal offense pursuant to an RPO; or
- An officer, after consultation with an on-duty supervisor, requires guidance regarding the
RPO process for a subject who appears to meet the RPO criteria.
A subject qualifies for an RPO when he/she meets the following criteria:
a. The subject poses a significant danger of causing personal injury to himself/herself or
others; and
b. The subject has made a credible threat against another person(s) by word or action; and
c. The subject owns, has care, custody, or control of, or has the ability to purchase,
possess, or receive firearm(s) and/or ammunition.
For any remaining firearm(s) and/or ammunition to which a Baker Act subject would still
have access (e.g., a firearm stored in the subject’s house, etc.) after he/she is released
from the mental health facility, the officer shall: Seek consent, when legal
consent has not been given Leave the items and
route any applicable reports to the RPU. If the RPO statutory
criteria appear to have been met, the RPU shall conduct further investigation in an
effort to obtain an RPO.
When a subject does not meet the criteria for an RPO, he/she can still voluntarily surrender
any firearm(s), ammunition, or concealed weapon licenses. In these circumstances, the
officer shall complete an Information Report and place the items in the Property & Evidence
Facility as _________.

All subjects arrested for criminal offenses pursuant to an RPO shall be
interviewed by an
RPU detective unless they refuse to participate or are otherwise unable to participate in the
interview.
All RPO surrender of firearm(s) and/or ammunition not transferred to a third party shall be
submitted to the Property & Evidence Facility under
the RPO property classification.
RPO respondents have the ability to petition the court to vacate an RPO. If a judge orders an
RPO be vacated prior to the previously ordered RPO ending date, any firearm and
ammunition surrendered shall be made available for return but shall not be disposed of for
a period of_________ after the order to vacate was granted by a judge.
