If an officer believes a physical arrest is warranted for an offense otherwise eligible for a juvenile civil citation the officer must notify his supervisor. If the officer supervisor is not available, the officer shall request a supervisor respond to the scene. The supervisor must respond to the scene, review the case with the officer, and approve the physical arrest.

If the officer believes the release of a juvenile constitutes a public danger and the juvenile qualifies for a juvenile civil citation, the officer shall follow the supervisory notification process. Responding supervisor shall assess whether placement with other family, YCC, the juvenile assessment center (JAC), a baker act would mitigate the threat. If the supervisor determines placement will not mitigate the threat, the citation shall not be issued or shall be initiated.

When a citation is issued to a qualifying juvenile offender for any act of domestic violence, the officer shall ensure the juvenile is placed with a family member or responsible individual. The person taking responsibility for the juvenile will be advised that any further contact with the victim may result in immediate arrest and rejection from the program. Officers shall notify their supervisor of the arrangement. The supervisor must respond to this and approve of the arrangement prior to the Offender being placed with a family member responsible adult who is personally known to the juvenile or family unit.
There is no limit to the number of offenses that may be listed on a juvenile civil citation.
If the investigating officer feels an arrest is appropriate based on four or more qualifying offenses, that officer’s supervisor, or an on-duty supervisor must respond to the scene, review, and approve the arrest.
