A

C(signage).
The Los Angeles Municipal Code prohibits the posting of signs on public property. The appellee was the Taxpayers for Vincent, a group of supporters of a candidate for election to the Los Angeles City Council, entered into a contract with appellee Candidates’ Outdoor Graphics Service (COGS) to fabricate and post signs with the candidate’s name on them. COGS produced cardboard signs and attached them to utility pole crosswires at various locations. Acting under the code in question, city employees routinely removed all posters attached to utility poles and similar objects covered by the ordinance. Appellees then filed suit in Federal District Court against the appellants alleging that the code abridged appellees’ freedom of speech within the meaning of the First Amendment, and seeking damages and injunctive relief. The District Court entered findings of fact, concluded that the code was constitutional, and granted the City’s motion for summary judgment. The Court of Appeals reversed, reasoning that the ordinance was presumptively unconstitutional because significant First Amendment interests were involved, and that the City had not justified its total ban on all signs on public property. Suitum v. Tahoe Regional Planning Agency, 520 U.S. 725 (1997).
Mrs. Suitum argued that the Tahoe Regional Planning Agency effected a regulatory taking when it determined that her residential lot was ineligible for development under restrictions designed to protect Lake Tahoe. The Agency argued that the claim was unripe because Suitum had not attempted to sell TDRs to which she was entitled. After reaffirming its established ripeness doctrine in takings cases, the Court held that the claim was ripe because the value of her land could be determined without a sale of the TDRs. The Court rejected a takings challenge to the zoning ordinances that allowed the claimants to build between one and five homes on their five-acre parcel. Because the landowners had not submitted development plans as permitted by the ordinances.
The Court concluded that there was no concrete controversy regarding the application of the ordinances to the land. The Court also held that there was no facial taking because the ordinances did not deny the landowners of all economically viable use of the land and substantially advanced the State’s legitimate interest in preserving open space.

A(1,2,3).
The 1901 New York State Tenement House Law was the legislative basis for the revision of city codes that outlawed tenements such as the “Dumbbell Tenement.” For this law, Lawrence Veiller was the leading reformer.
Legislation was desperately needed to improve the construction of tenements. To this end, and spurred by the high death rate of the City-which in 1900 stood at 20.57 persons per thousand (compared to 33 persons per thousand in 1866)-the Tenement House Act of 1901 was passed.
Many of Manhattan’s leading physicians drew a link between tuberculosis and congestion in the City’s tenement houses. Physicians attributed 8,000 to 9,000 deaths a year to tuberculosis, mostly in the poorest and most unsanitary neighborhoods of the City. Yet conditions in tenement houses may have been influenced not only by crowding, but also by the construction and use of the tenement itself. Hermann Biggs, the New York City Health Commissioner who waged a campaign against tuberculosis in the late nineteenth century, argued that while population density generally could be considered a good indicator of mortality, this did not always hold true for New York City. Biggs found that “in some of the wards where the density of the population is the greatest the mortality has been below the average, and in other wards with a relatively scarce population the mortality has been extremely high.”
All tenement houses constructed after the passage of the 1901 law were referred to as “new law” tenements. This most recent tenement house legislation reinforced the need for ventilation and light in ameliorating the morbidity and mortality that characterized life in the tenement house districts.

A(Lucas v. South Carolina Coastal Council).
In 1986 Lucas intended to build a house on each of his two properties, but before he could do so, the South Carolina Coastal Council drew “setback lines” along the coast, including one that fell behind his properties. Lucas could no longer build permanent structures. He sued the council, claiming that the state’s 1988 Beachfront Management Act took his property without compensating him. In its 1992 ruling the U.S. Supreme Court said that a taking occurs in two circumstances: when there is a “permanent physical invasion” of property and when “regulations deny the property owner of all ‘economically viable use of his land.’” The ending is that the state bought the properties from Lucas and later sold them for development. Performance Zoning can be described as which of the following?

C(regulates the character of the use instead of simply just regulating the use itself).
Zoning districts may be set up into many different ways.
1. Cumulative (or pyramid), this is when permitted uses automatically accumulate from one district to each successive one. In this, the single detached residence is the top.
2)Exclusive classification, allows no uses in districts than the uses for which they were created. An example for this is to stop residential from “taking over” another land use like commercial and then protesting when a commercial use is proposed.
3)Performance Standards, establish objective thresholds and maximum limits of the effects or characteristics of a land use (e.g.: allowable amount of noise).
4)Performance Zoning, regulates the character of the use instead of simply just regulating the use itself.
5)Mixed-Use districts, permitting mixed uses.
6)Planned Unit Developments (PUD), allows a mix of uses and flexibility in design.
7) Overlay zones, these add requirements “on top” of zoning districts.
8)Incentive Zoning, cities can use these to encourage development that exceeds the minimum standards.
9)Transferable Development Rights (TDR), allows property owners with limited development rights to buy additional rights from another property owner.

“Landmark Planning Case”
Penn Central Transportation Co. v. City of New York
Summary
The New York City Landmarks Preservation Commission applied a historic preservation law to deny the owners of Grand Central Terminal permission to build a 50-plus story office building over the Terminal. The Court held that regulatory takings analysis should focus on the landowner’s parcel as a whole, not just the portion of the property affected by the challenged regulation.
In a nutshell, Penn Central could still use the terminal its business, which was as a train terminal, not an office tower.

One of the biggest concerns is the assumption that PUD’s mostly contain single-family homes (although that is never directly stated). The main point of this question is to understand that many argue (and agree) that single-family homes generate the most average vehicle trips per unit. This question does not provide this as a correct answer and therefore, you must choose the next best answer which, according to the book is Planned Unit Developments. When looking at the other choices provided, which are all Mult-family, this is the best answer provided.

The correct answer is Austin v. Older. The plaintiff built a gas station on his property the day before the City of Ypsilanti enacted its zoning ordinance that zoned the property as Residential. Ten years later, when the plaintiff tried to get a building permit to remodel the gas station, the City refused to issue the permit. The court concluded that since the structure was not in accordance with the provisions of the zoning ordinance, the refusal was proper and there was no abuse of discretion.

Berman v. Parker, 348 U.S. 26 (1954).
The federal District of Columbia Redevelopment Act of 1945 created a program to redevelop substandard housing and blighted areas in Washington, D.C. The Act created the Redevelopment Land Agency. This Agency had the power of eminent domain to acquire real property as part of the redevelopment program. The owner of a department store, Berman, argued that the government could not acquire his property through eminent domain because the property would be redeveloped for private use and thus violate the requirement in the takings clause that any taking be for a public use. The Court held that the redevelopment of the District of Columbia was a public purpose for which the U.S. could properly exercise its power of eminent domain. The Court added that legislative declaration of the public interest is “well-nigh conclusive.” Source:http://www.communityrights.org

Pumpelly v. Green Bay Co., 80 U.S. (13 Wall.) 166 (1872).
The Court held that a taking occurred where a state authorized dam caused the flooding of private property from the time of the dam’s completion to the start of the landowner’s lawsuit. The Court observed that it would be a “very curious and unsatisfactory result” to conclude “that if the government refrains from the absolute conversion of real property to the uses of the public it can destroy its value entirely. It can inflict irreparable and permanent injury to any extent, and can subject it to total destruction without making any compensation ….” Because the flooding was the equivalent of an expropriation, the court found it to be a taking.

B)

In this situation, the BEST choice is that you do B. This is the best way for you to protect yourself ethically. Of course, a public planner can become a planner for a private developer and vice versa. The code talks about how the conflict may arise as soon as the discussion starts about a possible move. The public employer must be notified right away, even though the job may not come to fruition. It is much earlier than other types of jobs because of the conflict that could occur from a public employee influencing decisions that affect the interests of the potential new boss (i.e.: developer).

B(1,4).
Visioning is different from planning’s tradition of public meeting goal setting because the goals are typically based on what already exists in the community. It does not look at any of the existing opportunities or constraints n the community. It is a projection of what is desired. Visioning does not require extensive data collection. B(PPBS).
PPBS was developed in the 1960’s. There are three main points of this budgeting technique. The first, it is organized by program instead of functional objects. The second, PPBS extends programs out into the future to look at the spending implications. And the third, all of the programs are put through quantitative analysis. A key point to remember, PPBS is focused on planning, not budgeting.
