To accomplish its mission, the EPA works closely with communities, Potentially Responsible Parties (PRPs), scientists, researchers, contractors, and state, local, tribal, and Federal authorities. With these groups, the EPA identifies hazardous waste sites, tests the conditions of the sites, formulates cleanup plans, and cleans up the sites. The Superfund Trust Fund was set up to pay for the cleanup of these sites. The dollars comes mainly from taxes on the chemical and petroleum industries. The Trust Fund is used primarily when those companies or people responsible for contamination at Superfund sites cannot be found, or cannot pay for the cleanup or perform the cleanup work.

Legislation was desperately needed to improve the construction of tenements. To this end, and spurred by the high death rate of the City-which in 1900 stood at 20.57 persons per thousand (compared to 33 persons per thousand in 1866)-the Tenement House Act of 1901 was passed.
Many of Manhattan’s leading physicians drew a link between tuberculosis and congestion in the City’s tenement houses. Physicians attributed 8,000 to 9,000 deaths a year to tuberculosis, mostly in the poorest and most unsanitary neighborhoods of the City. Yet conditions in tenement houses may have been influenced not only by crowding, but also by the construction and use of the tenement itself. Hermann Biggs, the New York City Health Commissioner who waged a campaign against tuberculosis in the late nineteenth century, argued that while population density generally could be considered a good indicator of mortality, this did not always hold true for New York City. Biggs found that “in some of the wards where the density of the population is the greatest the mortality has been below the average, and in other wards with a relatively scarce population the mortality has been extremely high.”
All tenement houses constructed after the passage of the 1901 law were referred to as “new law” tenements. This most recent tenement house legislation reinforced the need for ventilation and light in ameliorating the morbidity and mortality that characterized life in the tenement house districts.

The New York City Landmarks Preservation Commission applied an historic preservation law to deny the owners of Grand Central Terminal permission to build a 50+ story office building over the Terminal. The Supreme Court reviewed three factors in determining that the permit denial did not constitute a regulatory taking: (1) the character of the governmental action; (2) the economic impact of the regulation on the landowners; and (3) the extent to which the regulation interfered with investment-backed expectations.
