When can decisions be overruled for children?
16 and 17 year olds
May make independent decisions, but as they are not 18, they don’t have full autonomy and decisions can be overruled
When can a child under 16 make treatment decisions?
If they are deemed to have Gillick competence
What is Gillick competence?
Judgement about whether understanding and intelligence of the child is sufficient to consent to treatment
Decision by decision basis
When prescribing contraception to under 16s what must be done?
Voluntary consent
Assess for coercion or pressure by older partner
What are Frazer guidelines?
Specific guidelines for providing contraception to under 16s without parental input and consent
What are the Frazer guideline criteria?
- Mature and intelligent enough to understand treatment
- Can’t be persuaded to discuss with parents or let HCP discuss with parents
- Likely to have sex regardless
- Physical or mental health with suffer without treatment
- Treatment in best interest
Should be encouraged to inform parents, Gillick competence and Frazer guidelines can be kept confidential
When should intercourse always be escalated as a safeguarding concern?
Children under 13 years old
