By a court order
By a physician, clinical psychologist, psychiatric, nurse, mental health, counselor, marriage, and family therapist, or clinical social worker
By a law enforcement officer
Can a sworn member exercise the provisions of a baker act on the advice of relatives alone?
No, circumstances must exist which allow the sworn member to determine that the subject is a danger to him/herself or others, and that immediate transportation to a receiving facility is necessary
How must subjects being transported under baker act be restrained?
Subjects being transferred under your bank account must be restrained in the least restrictive manner available and appropriate under the circumstances. This does not preclude Officer safety as being a Paramount importance or utilizing mechanical restraints. The method of restraint should be described as well as the justification in the offense incident report.
