No, circumstances must exist which allow the sworn member to determine that the subject is a danger to him/herself or others, and that immediate transportation to a receiving facility is necessary

How must subjects being transported under baker act be restrained?

A

Subjects being transferred under your bank account must be restrained in the least restrictive manner available and appropriate under the circumstances. This does not preclude Officer safety as being a Paramount importance or utilizing mechanical restraints. The method of restraint should be described as well as the justification in the offense incident report.
