Imminent Threat
Demonstrated actions that would lead a reasonable sworn member to believe the suspect poses a threat; has the ability, opportunity, and intent to carry out the threat; and will continue to pose a threat if not apprehended without delay, regardless of whether the threatened action has been initiated.
3 Criteria for making deadly force decisions
Ability, opportunity, and intent
Ability
Refers to the subject having the means to carry out their intent to cause death or great bodily harm. A sworn member must determine whether the subject has the necessary means to cause death or great bodily harm to the sworn member or others. A weapon is not required; a subject must only have the apparent ability to carry out their intention.
Opportunity
The subject is capable of acting on a plan to cause death or great bodily harm to the sworn member or others. The type of weapon being used by the subject and the subject’s proximity to the sworn member or others are determining factors to consider in a sworn member’s assessment of the subject’s opportunity to carry out their actions.
Intent
A reasonably perceived, imminent threat to a sworn member or another person based on the subject’s actions, behaviors, words or other indicators. It is a perception derived from the totality of the circumstances.
De-escalation
De-escalation techniques shall be used whenever possible. When resistance de-escalates, so must the sworn members response.
