When should a vehicle be examined?
If there is a serious or fatal incident,
There is allegation or suspicion that a defect contributed to then crash
Evidence arises than a defect could have caused the crash.
Who can examine a motor vehicle and ascertain if it complies with standards?
An authorised examiner
E.g. Someone authorised by DVLA
PC authorised by chief constable
Police mechanic
What powers exist to examine vehicles?
Sec 74- examine vehicle within 48 hours of crash.
Don’t need owners permission but need permission to enter premises
What offences exist for tyre structure? (Reg 26)
Pneumatic tyres of different structures cannot be fitted on the same axle
And
If 2 axles, can’t have cross ply at back if radial ply at front.
What offences exist in relation to condition of tyres?(reg 27)
Offence to use or cause or permit use of a. While of any of the tyres have any of the following defects:
Unsuitable tyres for the vehicle
Not properly inflated
Cut deep enough to reach the ply or cord
Lump, bulge or tear caused by separation or failure of the structure
Exposed ply or cord
Also, tread of tyre min 1.6mm (cars, bikes and lgv)
Hgv must have tread of 1mm
What offences exist in relation to silencers? (Reg 54)
Offence to use, or cause or permit to use a vehicle propelled by a combustion engine on a road if:
Exhaust gases don’t pass through the silencer,
Silencer and exhaust are in poor condition,
Or
The silencer has been adapted to increase noise made
What offences exist in relation to horns? (Reg99)
Offence to cause, or permit the horn to be sounded if:
Vehicle is stationary (unless danger of another moving vehicle)
On a restricted (built up) road between 23.00-7.00
The born is a 2 tone, bell, or siren
Not an offence if:
Use in an emergence
Use by emergency services
Anti theft device
Used by bus drivers to summon help
What offences exist in elation to windscreen wipers & washers? (Reg 34)
Every vehicle with a windscreen must have at least 1 wiper capable of clearing the windscreen, and also a washer to use in conjunction with the wiper which is capable of clearing the windscreen of dirt etc.
What vehicles don’t require windscreen washers?
Agricultural vehicles
Vehicles not capable of over 20mph
Local buses
What are daytime hours?
Half an hour before sunrise to half an hour after sunset
What are hours of darkness?
Half an hour after sunset to half an hour before sunrise
What lighting offences exist? (Reg 23) any defences?
Reg 23, maintenance= offence to use or cause or permit use of a vehicle of lights and reflectors are not kept in working order.
Reg 11- colour of lamps, must not be blue
Defence- occurred during that journey or already taken reasonable steps to rectify (ordered parts)
Reg 25- offence to be in motion on a road, or park on a road between sunset and sunrise without side lights and reg plate lights to be lit. Parking offence does not exist if it is in an area of 30mph or less speed limit.
Reg 11- offence to have red light at front or white light at rear (not reverse lights)
Reg 25- offence not to have headlights on in hours of darkness while in motion on a road
Reg 27- to use lights causing undue dazzle or discomfort to other road users (offence to use fog lights other than when necessary)
What do hazard lights on a bus or coach signify?
Driver requires assistance
What offence exists for parking between sunset and sunrise?
To park facing the wrong way, unless: Permission from police Emergency service Vehicle is used in connection with building, road or vehicle maintenance Vehicle being used as a taxi or bus
