What does sec 6 give the power to do?

A

Require a breath specimen of a person who has been driving, attempting to drive, or in charge of a motor vehicle on a road or other public place if a PC in uniform has cause to suspect that:
The person has alcohol in their body,
The person has committed a moving traffic offence,
Or
The person was involved in a rtc (uniform not required)

A

For any person to drive, attempt to drive, or be in charge of a motor vehicle on a road or other public place, having consumed alcohol in such quantity that the proportion of alcohol in their breath, blood, or urine exceeds to prescribed limit.

A

If there is reason to believe the suspect is inside and it is in the interests of justice to do so, but on,y if:
Has been a rtc (whether in hot pursuit or not)
Or
Person is suspected of drink driving but no crash, and police are in hot pursuit
