Define forgery and uttering
A crime at common law and is the mAking and publishing or writing feloniously intended to,pass and represent the genuine writing of another person
What are the essential elements for forgery & uttering?
The document was forged
Forged document was tendered
Was uttered with intent to disadvantage the person
The actual forger of the document is not guilty unless he tends it. It is the tender who is guilty.
What are examples of forged documents?
Fabricating a document inc the signature
Applying a false signature to a document
Transferring a signature onto a fabricated document
Altering a signed document without consent
Putting writing above a signature
