What is a relevant area?
Areas of the ground to which spectators have access on payment OR from which the event can be viewed directly
What is a designated sporting ground?
Any ground hosting major football matches
What is the period of a designated sporting event?
A period which commences 2 hours before the start or advertised start and concludes 1 hour after the event finishes
What is a controlled container?
Any container of any description which is or was capable of holding any liquid, and is made from a material which, if the container were to be thrown or propelled at a person could cause injury to that person.
What is meant by presumption of contents?
Any liquid found in a container whether sealed or open shall be presumed to be whatever is on the label.
What is it an offence to enter/ attempt to enter a designated area with?
A controlled container,
Alcohol,
Fireworks or flares,
Or to be drunk
What offences exist for traveling to and from a designated area?
Sec 19 of the criminal law consolidation (scot) act- An offence to be drunk or to be in possession of alcohol on any psv or train which is being used to take people to or from a designated sporting area.
It is an offence for the passengers and also the hirer, operator, and employer.
What powers exist for sec 19?
Stop and search vehicles during period of designated sporting event
Search passengers you suspect
Seize any controlled containers and contents if suspicious
Seize any fireworks.
Arrest anyone committing the offence
What elements are required for the offensive behaviour at football and threatening comms (scot) act 2012?
Offence to engage in behaviour (single or course of conduct) which:
Is likely to incite public disorder,
Or
Would be likely to incite public order
What is a regulated football match?
Any match involving an international team belonging to the SPL, the football league, football association premier league, football conference or league of Wales.
When would behaviour be in relation to a regulated football match?
In the ground on day of match,
While entering or leaving ground,
On journey to or from match,
OR,
behaviour is directed to someone as above.
So also includes places where match is televised.
What would you do with someone committing a sec 1 offence (threatening comms)?
Could fpn, detain, or could arrest- silent power and punishable by imprisonment.
What is a football banning order?
An order which prevents a person from entering any football ground in UK when it is used for a match.
Can extend abroad.
Given for a specified time.
When is a banning order given?
When a person has committed an offence related to football, violent or disorderly, and is over 16.
It can be given instead of, or as well as a sentence.
How is a banning order given?
On conviction- on conviction, request for a banning order can be noted in the remarks section of police report.
Or…
On summary application- made on behalf of chief constable of the area where the accused resides. If the accused has ever contributed to violence or disorder in connection to football matches.
