What is culpable and reckless fireraising?
A
When a persons property is set on fire as a result of a reckless act by the accused.
Must show that reckless disregard for the result was present.
Cannot be accidental, no crime if accident.

What is wilful fire raising?
A
When a person intentionally sets fire to any form of property.
Must prove intent to set fire, no recklessness however stupid.
If set fire for insurance purposes then it is fraud.

What statutory offence exists for fireraising?
A
Sec 56 = offence to have a fire in any public place which:
Causes danger to persons or property,
Or
Causes reasonable cause for alarm or annoyance.
(Public place includes common areas)
