What vehicles are exempt from requiring insurance?
- Crown owned vehicles
- Local authority vehicles
- Police vehicles
- Vehicles owned by person who has £500,000 deposited with supreme court
- Vehicle being driven for police purpose or under direction of a PC
What offence exist for insurance?
Sec 143 offence to use, or cause or permit the use of a motor vehicle on a road or other public place without insurance of at least 3rd party
Sec 144 offence to keep a vehicle uninsured, even if not being driven, must be SORN’d.
What defence exists for driving without insurance?
The vehicle didn’t belong to the driver, it was not hired to the driver, and it was being driven in the course of employment and they didn’t know, or have reason to believe the car wasn’t insured.
What powers exist for police in relation to insurance?
Require production of certificate from anyone who:
- Is driving a motor vehicle on a road, or
- You have reasonable cause to believe they were driving at the time of an accident they were involved in, or
- You believe they have committed an offence in relation to the motor vehicle
If they don’t provide them and you believe they are committing an offence you can seize the vehicle after warning them that you will do this if they don’t produce the docs. If they drive off you can seize the vehicle within 24 hours from anywhere in garage or driveway
