What is an adult at risk?
Over 16 who: Can't safeguard themselves, property, or rights Are at risk of harm And Have a disability or mental disorder All 3 must be present
What are the 3 types of protection order?
- Assessment order
- Removal order
- Banning order
What is an assessment order?
Done by local authority Allows council officer to take adult for a private interview and medical exam Valid for 7 days Establishes if adult is at risk Is voluntary, can leave at any time
What is a removal order?
Granted by sheriff, Allows council officer to remove adult to a specified place Must be executed within 72 hours Valid for 7 days Voluntary- can leave at any time
What is a banning order?
Granted by sheriff,
Bans specified person from being in specified place for up to 6 months
Can be temporary until full one issued
Can carry a power of arrest
What offences exist?
Offence to obstruct anyone doing anything involved in any of the orders
What is a protected adult?
Over 16 who is provided with care or welfare support
What does the PVG scheme do?
Regulates who can work with children and vulnerable adults
Makes it an offence for any person included on the register to work in a position of care, and a offence for any employer to employ someone on the register
