What is a public road?
A road which a roads authority has a duty to maintain
Define a road
Any way other than a waterway over which there is a public right of passage by whatever means, whether subject to a toll or not, and includes any verges and bridges (permanent or temporary) over which, or tunnel through which the road passes, and any reference to a road includes parts thereof.
What is a mechanically propelled vehicle?
Vehicle which is propelled by internal combustion engine, steam, or electricity. It remains an mpv if the motive power can be readily applied or re applied (e.g. Car with no engine)
What is a motor vehicle?
A mechanically propelled vehicle which is intended or adapted for use on the roads
Adapted = adding mirrors or indicators etc to a rally car, off road vehicle
Ride on law mower is not a motor vehicle
Define driving
A person is deemed to be driving if they have control of the speed an direction of the vehicle
Inc’s towing (not a rigid tow), pushing a car and jumping in it
What is attempting to drive?
An action which if completed would cause the car to move
