When is tent not a premise?

Section 17(1) PACE 1984
You believe a person is in a premise for the purpose of:
-Warrant
-Person for indictable offence
-Specified offences
-Pursuing an escaped prisoner
If you suspect it is necessary to save life/propertyy from serious damage

Section 18(1) Summary
-Enter and search the property of someone under arrest for an indictable offence if you suspect there is evidence on the premises.
NEEDS inspector to give written authority.
Section 18(5) summary
Search before taking a person to a police station without authorisation if the presence of that person is necessary for an effective investigation of the offence.
INSPECTOR to be informed as soon as practicable after search.
Searching Premise with Consent
Can get written consent (not under duress & should consult with supervisory officer) to search a premise.
Section 32b PACE
Officer can enter and search any premises where the person:
-Was arrested
-Immediately before they were arrested
FOR an indictable offence only and believe there is evidence relating to the offence on the premises.
Section 19 PACE
Constable may seize anything;
-use in the commission of the offence
-evidence for the offence or any other offence
