Reportable Road Traffic Collision Definition - S.170(1) Road Traffic Act 1988
If owning to the presence of a MPV (mechanically propelled vehicle) on a Road or other Public Place;
a) Injury is caused to a person (other than the driver)
b) Damage is caused to
i) A vehicle (other than the MPV or trailer)
ii) An animal (other than one carried in/on MPV/trailer)
iii) Property
Then the driver must STOP
S.170 ‘Owing to the Presence of’
Must be a connection (not necessarily directly) between the vehicle and the collision.
-Applies when the person was injured whilst leaving a moving vehicle
-Can include another vehicle to vary from their intended course (causing another to swerve)

Person can still be driver even thought the have stopped and switched off the engine some minutes before collision.

S.170 ‘property is damaged’
Includes property constructed, fixed, growing or forming part of the land or land adjacent. Trees, crops and plants are property in this act.
E.g. Signs, Lights, Buildings, Fences, Walls
S.170 Driver Responsibilities
Driver must stop after a RTC.
if there is any IPAD - Injury, Damage, Animal, property
then there are responsibilities are placed on the Driver.
S.170 Obligations after stopping (animal/property)
Must provide Name/Address of (victim and owner and driver).
Identification Marks of the vehicle to anyone who has reasonable grounds to require.
If driver does not give name/address he must report the accident within 24 hours at a police station or to a constable

Drivers of other vehicles involved
Passengers in other vehicles involved
Injured parties
Owners of damaged property of their representatives.
S.170 Driver obligations (Injury)
ALSO certificate of insurance or other evidence of third part insurance cover.
If they do not produce certificate they commit an offence
S.70 ‘Stop’
Means stopping and remaining at the scene for sufficient time to able anyone who has a right or reasonable grounds to obtain information from the driver (direct and personally, can’t be passenger)

RTC needs a report completed if….
-S.170 was not complied with
-Offence contribute to the collision and there is sufficient evidence/public interest to prosecute
-Vehicle used for policing purposes is involved
-Grounds for thinking that a vehicle defect was a contributory factor
-Grounds for thinking that a defect in the road was a contributory factor.

Category A - Scrap only
Category B - Body shell crushed - break for parts
Category S - Structural damage, can be professionally repaired
Category N - Non-structural damage - can be repaired
