What is “Common Carriage” vs “Private Carriage”
A common carriage “holds itself out” to the public, as its willing to accept any person who wants it.
A private carriage or “contract carriers” is usually selected customers on a long-term basis.
What is Holding Out?
Offering to carry passengers for hire without Air Carrier Certificate or Commerical Operator Certificate
121 vs 135?
Air Carrier Certificate is Part 121 (Airlines)
Commercial Operator Certificate is Part 135 (Air Taxi)
What can the FAA do if it finds you in violation of common or private carriage laws?
Revoke your license or issue a fine for each occurrence
What are Part 135 Pilot Qualification requirements?
Commercial Pilots Certificate with appropriate ratings, and a ATP or Instrument Rating. UNLESS
if it’s a turbojet airplane, has more than 10 passenger-seats, multi-engine in a commuter operation you need to have a ATP.
What’s needed for SIC qualifications?
Comm pilot certificate with appropriate ratings
Must meet IFR recency requirements if flight is done under IFR
