To what extent are states limited by the due process clause from infringing upon individuals' rights to privacy?
Substantive Due Process
Places substantive limits on the liberties the government can take form a citizen. if something violates a basic right, its unconstitutional.
Griswold v. Connecticut (1965)
Court ruled anti-birth control laws unconstitutional. Expressed a right to privacy.
Give background for Roe v. Wade (1973)
McCorvey was pregnant and tried to get an abortion. Texas wouldn’t let her get an abortion.
