Members may file complaints for ?
RETALIATION- for filing a complaint, cooperating in an investigation or requesting a reasonable accommodation
Member may file an EEO complaint in the following ways:
- Directly with EEO OFFICER: -in person at EEO OFFICE
- MAILING a letter or EEO COMPLAINT FORM to EEO OFFICE
- BY TELEPHONE
- BY EMAIL
- TO OFFICER/SUPERVISOR who will communicate inquiry or complaint to EEO OFFICE
- EEO counselor/ who will communicate to EEO OFFICER
Member ay also file complaint will following agencies:
HUMAN RIGHTS COMMISSION
DIVISION OF HUMAN RIGHTS
EEO COMMISSION
DEPARTMENT OF LABOR, OFFICER OF FEDERAL CONTRACT COMPLIANCE PROGRAM
SEXUAL harassment complaints may be filed directly to BITS
Upon Notification to an Officer by a member of an incident, the Officer shall ?
A. INFORM member of available FILING OPTIONS
AND
B. NOTIFY EEO OFFICER - Routine notifications: Phone (0800-1800, MONDAY-FRIDAY, see exception below) or Email
note: if incident effects operations..Officer will contact EEO Officer during officer hours VIA PHONE (0800-1800)….NON-office hours- FDOC
Member is NOT required to give Officer any other information regarding complaint….
if member elects VOLUNTARILY to provide any information regarding the alleged incident, OTHER than the fact that a complaint is being made the OFFICER is then required to complete a CONFIDENTIAL EEO INCIDENT REPORT
CONFIDENTIAL EEO REPORT..?
submitted DIRECTLY (bypass chain of command) to the EEO officer in a sealed envelope marked ‘CONFIDENTIAL’…(no endorsements-NO BC, DC, etc.)
- NO COPIES retained by Officer
- EEO Officer will send letter of confirmation to Officer
- Officer shall be guided by instructions from EEO officer

Member has right to meet privately with the EEO officer or an EEO attorney/investigator during office hours..however member should obtain APPROVAL from OFFICER prior to leaving work/assignment…
REASONABLE leave requests to meet with an EEO office rep. during work hours CANNOT be denied by supervisors
- member need not disclose to an Officer, the details or purpose for meeting
- OFFICER shall allow members to meet with EEO rep. at the EARLIEST PRACTICABLE TIME CONSISTENT WITH THE OPERATIONAL NEES OF THEIR UNITS
ALL FD personnel involved in the investigation of an EEO complaint are required to maintain CONFIDENTIALITY (don’t discuss anything)
