The place of assemble permit is valid for
- One (1) year
- Posted in a conspicuous place, framed and mounted
- Certificate is numbered
- Has the number of people who may legally occupy the space
Places of assembly
Inside buildings 75 or more people
Outside 200 or more people
Under the 2008 building code the permit for a place of assembly is called a
Certificate of Operation. Therefore since all permits issued under the 1968 building code have expired (permit term is only one year) a Certificate of Operation shall be posted
A cabaret (occupancy group F-4) shall include buildings and spaces in which
Persons assemble for dancing OR for consumption of food OR drink, or any combination of dancing, eating, drinking or entertainment
Cabaret does not include
Premises with less than 75 people
Premises with 75 or more people with incidental entertainment
Incidental entertainment is defined as
- Food or drink
- NO DANCING
- Not more than 3 persons playing instruments
- Not more than 1 singer accompanied by 1 person playing instrument
- Place is leased or hired for a single event and public not admitted
Illegal social club is defined as
Does not comply with cabaret rules This is to be judged by the *Size of room *Number of tables and chairs *Bar set up *Stage size *Dance floor size
A Certificate of Occupancy shall be required for the following places of assembly
*Indoor places for use by 75 or more people including open spaces at 20 feet or more above or below grade, such as roofs or roof terraces
Outdoor places for use by 200 or more persons
A Vacate AND Seal order shall not be issued for
Space lawfully used for residential purposes
If the remedy of any hazardous condition cannot be accomplished immediately a VIOLATION ORDER may be more appropriate than a Vacate Order. This shall be in ADDITION to the summons issued for the illegal condition. In cases of overcrowding of the premise, in lieu of the Vacate Order, the following procedure may be followed:
- Summons issued
- Occupant load is reduced to the legal limit
- VO is issued to maintain the legal limit over a specific time period (ex 30 days). The premises should be monitored and the VO deemed satisfied or further enforcement action should be issued as necessary
