When are you permitted to take a child into custody?

A

14-6-205. Taking of child into custody; when permitted.

(a) A child may be taken into custody by a law enforcement officer without a warrant or court order when:

(1) The circumstances would permit an arrest without
a warrant under W.S. 7-2-102;

(ii) There are reasonable grounds to believe the child has violated the terms of an order of the juvenile court issued pursuant to this act; or
(iii) Repealed By Laws 1997, ch. 199, $

  1. (iv) The child’s conduct or behavior seriously
    endangers himself or the person or property of others and immediate custody appears necessary.

A

No, not if they stay within the building

If student leaves without permission, what can you do?

A

If they leave, you can cite for truancy, but you can’t arrest for disobey lawful order. Also be careful in chasing them down. Immediately call parents and if they have an issue, then get the kid

When juvenile refuses to identify themselves, what could happen?

A

On May 4th, 2020 at about 1900 hrs. I was dispatched to a school reference a possible physical disturbance. RP called after observing several juveniles fighting on the school playgrounds. She was able to provide all the descriptions of the juvenile males who were all contacted.
Upon arrival, juvenile was contacted and was being investigated due to a possible fight occurring at the location. SGT was requesting all individuals to identify themselves which juvenile was one of the individuals. Juvenile refused to provide his name after being asked twice and was placed in handcuffs. No force was used other than standard handcuffing procedures. The handcuffs were checked for tightness and double locked.

Juvenile was escorted to my patrol vehicle which he then gave the name of an actor. Juvenile is currently on a CHINs petition and probation. It was requested by the DA that the Juvenile be arrested and transported to the jail. I transported juvenile to jail. I completed a PC affidavit for juvenile.

Juvenile was charged with 6-5-204 (A) - Interference with Police Officer and Fighting.
