What are damages in terms of sport and the law?
individuals seeking legal redress for the compensation of loss of earnings must prove they have suffered an actual injury as the result of the deliberate, harmful, reckless actions of an opponent
What is the restraint of trade?
action that interferes with free competition in a market. may involve a clause in a contract which restricts a person’s right to carry out their profession
What are the reasons that sports performers may need assistance from the law/ sports legislation during their sporting careers?
Spectators attacking players Opponents being 'too violent' Contractual issues with sponsors Contractual issues with employers Equality of opportunities issues e.g. racism Refereeing negligence
Define negligence
conduct that falls below a reasonable person standard and leads to a breach of the duty of care, which results in foreseeable harm to another OR failure in the duty of care to a player
What is duty of care?
a legal obligation imposed on someone if they are responsible for a group of people
What is an in loco parentis?
‘in the place of a parent’ the authority parents assign to another responsible adult who will be taking care of their child
Give examples where an official could be negligent
- not enforcing the rules properly
- allowing a game to take place on an unsafe pitch that hasn’t been checked
- repeatedly allowing dangerous incidents to occur e.g. scrum collapse
- failure to follow NGB rules/guidelines to safe procedures
What are the 4 legal responsibilities that a coach has to their athletes?
- health and safety: should have access to first aid facilities and means to contact emergency services
- protection from abuse: from all forms of abuse e.g. emotional or physical, all organisations should have guidelines a coach should adhere to
- supplements: legal and ethical responsibility to educate about drug use and abuse as well as advice on legal nutrition and supplements to enhance performance

What laws are in place to try to control fan behaviour?
illegal to invade playing surfaces or use racist chants
What measures are in place to try to ensure safety and overcome hooliganism at sports events?
- removal of perimeter fences and terraces, all-seater stadium
- control of alcohol sales on the way to the grounds at at the grounds
- specified kick-off times imposed by police
- increased security and police presence
- tougher deterrents e.g. banning orders, fines
