ORG 133 - WorkCover - 6.9 Resumption of Duty
All staff returning to work following time off for a work related injury are to obtain a WorkCover Certificate of Capacity - Full Clearance for preinjury duties before resuming their pre-injury work. This can be included in a certificate authorising time off (eg. unfit for duty 28 and 29 October, fit to resume 30 October).
FRV under it’s regulations, may also request operational staff to attend the Brigade Medical Services (BMS) to confirm fitness for duty before resuming work.
ORG 133 - WorkCover - 6.3 WorkCover Certificate of Capacity
- These must be an authorised WorkCover Certificate of Capacity
- The initial certificate cannot be for a period exceeding 14 days and must be issued by a medical practitioner
- Subsequent WorkCover Certificates of Capacity can be issued by medical practitioners, physiotherapists, osteopaths or chiropractors for periods of up to 28 days
- The claimant must obtain and submit ongoing WorkCover Certificates of Capacity to FRV WorkCover Claims section to ensure the claimants pay continues.
-Certificates must be continuous (no overlapping dates or missed dates), and not just covering rostered shift days. - To ensure the WorkCover Certificate of Capacity is valid the claimant must complete the patient declaration on the 2nd page of the certificate. It is advised the person issuing the certificate also witness and date the patient declaration.
ORG 133 - WorkCover - What is the OIC responsible for when a claim is sought?
The immediate OIC/Supervisor of the claimant is responsible for;
- Ensuring the initial FRV Safe Report is completed as soon as practical and assigning the FRV Safe Report to an appropriate investigator
- Completing the initial FRV Safe Report when a claimant is unable to do so and assigning the FRV Safe Report to an appropriate investigator
- Reporting to the FRV WorkCover Claims Section any additional information that may assist in making a decision concerning the acceptance of liability
