Manchester Project - Subcontract document – What did this constitute of and what was your contribution in compiling these?
This consisted of the subcontract order cover, contract particulars, the main contract, ISG subcontract terms and conditions, scope of works, key dates schedule, Contract Sum Analysis, Post Tender Queries, Design Responsibility Matrix, Schedule of Specifications and Drawings, Valuation Dates, LADS AND Sectional Completion Dates, Logistics Plan, Pre-Start Meeting Minutes, Health and Safety Declaration and the Subcontractors Works Plan.
Manchester Project - Tell me more about the contract amendments. What were the implications and how did you address these within the subcontracts?
There were amendments to some contractor’s retention such as strip out and logistics where they were not installing work, as so there was no risk of them not having retention.
There were also amendments to the security contractors liquidated damages where their liability was limited.
How did the subcontract deal with payments?
Under the payment terms within the subcontract conditions.
For this specific contract subcontractors are required to issue their payment application on 17th of each month, where ISG will issue the assessment of this application on 28th of each month, where the payment certificate will follow 5 days from this date.
Tell me about your involvement in the assessment of liquidated and ascertained damages included in these subcontracts.
These were back-to-back with the liquidated damages in the main contract.
How did you deal with changes / variations?
Changes and variations must be instructed by an ISG Commercial Manager or ISG Project Manager or Project Director before works take place. These instructions will be issued in writing via email or on the digital document platform Aconex. Where cost and programme implications must be issued to ISG within 7 days of receiving the instruction.
Tell me about the options for valuing variations, including provisional sums that you refer to in your summary of experience.
In particular, this was a variation to the contract that was highlighted at tender stage, where steel supports for the folding wall were not specified in the Stage 4 Design. Therefore, this was provided as a provisional sum as a budget cost, until we could get a subcontractor to provide a firm price.
