I provided the client solutions to a problem by providing sound advice based upon advice received from engineering professionals to enable them to make a justified decisions whilst having knowledge of the costs, programme, and risks. This complies with rule 3 where members and firms must provide good-quality and diligent service.
Give me an example where you have implemented or acted in accordance with the new rules of conduct.
I ensure that I keep a record of the work that I undertake and decisions that are made so that I can promptly answer questions for clients and so that my work can be audited for quality assurance or regulatory purposes.
Give me an example where you’ve dealt with a conflict-of-interest situation.
During the tendering process I have been asked by unsuccessful subcontractors to disclose the details of the successful candidates bid as part of the feedback as to why they didn’t win the tender. I advised that this is an unethical practice that I would not be able to partake in as this conflicts with the Data Protection Act 2018.
Tell me about the recommended procedures from the RICS on how to deal with potential conflict?
Always act with integrity and avoid conflicts of interest and any actions or situations that are inconsistent with their professional obligations.
What is in the RICS guidance regarding gifts and hospitality?
Members and firms do not allow themselves to be influenced improperly by others (as a result of, for example, giving or receiving work referrals, gifts, hospitality or payments) or by their own self-interest.
Give me an example where you have implemented this.
I have implemented this when I received a gift around Christmas time from a subcontractor, but it was around the practical completion stage of the project and therefore final account stage. Because of this I rejected the gift politely by explaining that this would conflict with RICS Guidance on gifts and hospitality.
