What does internal affairs investigate?
(1) any event in which a person dies or suffers a critical injury while such person is in custody of or being taken into custody by an officer, and (2) any discharge of a firearm by an officer. And they shall investigate part I offenses.
What is part II Offense for IA and what who investigates them?
Courtesy, Abuse of Leave, Unsatisfactory Performance, Emergency Duty, Use of Dept. Equipment, Responding to Calls, Reporting to Duty, Reporting Change of Address/Phone, Abuse/Loss of Equipment, Knowledge of Laws and Regulations / Supervisor
Once a supervisor investigates a complaint what are they required to do?
Reduce their findings to writing and entered into BlueTeam format prescribed by the Office of Internal Affairs. The report shall be sent to the appropriate lieutenant or other civilian supervisor who shall in turn review the report and forward it to the Office of Internal Affairs where it shall be stored on file on a computer server.

After the ______ inquiry by a supervisor for similar policy violations by an employee in a twelve month period, the Office of Internal Affairs shall investigate subsequent allegations of similar violations against such employee until there is a twelve month period with no sustained allegations of that or similar violations.

If a supervisor finds that an allegation of a policy violation should be sustained they should do what?
The investigating supervisor shall also send any such report up the chain of command.
Each member of the chain of command shall, in turn, forward any sustained finding to his or her supervisor (up to the Chief of Police) with recommendations whether the alleged policy violation should be sustained. If it is determined that a more in-depth investigation is needed or allegations of violations of Part I offenses are revealed, the investigation shall be forwarded to the Commander of the Office of Internal Affairs for investigation.

Who can relieve someone from duty?
Chief of Police/Acting Chief and or Commander of Professional Standards. However, a supervisor can relieve any subordinate for the remainder of the employees shift, if they believe he/she is incapable of performing his/her duties.
The Chief of Police or his designee, shall be notified by the IA Commander, either by email or phone, of alleged employee misconduct. This allegations include:
a. Allegations against employee of felony criminal charges
b. Employee involved shooting
c. Excessive force involving serious injury, and
d. Incidents that present serious liability or community interest
Generally IA investigations should be completed within?
30 days
The report of investigation shall include a “conclusion of fact” based upon the findings of the investigation. Based upon the “conclusion of fact,” every investigation shall be classified according to the following:
a. Not Sustained – The investigation failed to produce a preponderance of evidence to either prove or
disprove the allegation;
b. Exonerated – The allegation in fact did occur but the actions of the employee were legal, justified,
proper and in conformance with the law and department policy and procedure;
c. Unfounded – The allegation concerned an act by a department employee which did not occur; or
d. Sustained – The investigation produced a preponderance of evidence to prove the allegation(s) of anact which was determined to be misconduct.
